Philly asks PA supreme court not to take up beverage tax suit

Philadelphia is asking the State Supreme Court not to hear the soda industry's appeal of the lawsuit challenging the tax on sweetened drinks.  Mayor Kenney claims the suit is preventing his anti-poverty agenda from progressing.  A lawyer for the city is arguing that the programs that will be funded by the tax are critical for the public's well being, while the two legal questions raised by the beverage industry are not important.  The industry wants to know whether the beverage tax is a sales tax or if it's not uniform, which is required by state law.
